Legal Paternity DNA Testing

A home DNA paternity test cannot be upgraded to a legal DNA test as a chain of custody procedure needs to be followed for a paternity test to be court admissible. Furthermore, the legal DNA test cannot be used for immigration purposes.

If you need paternity DNA test results for some legal purposes, then a Legal Paternity DNA Test must be performed. The common legal reasons for which the results of this tests can be used are:

  • Adoption
  • Birth Certificate
  • Child Custody
  • Child Support
  • Tax Forms
  • Will/Estate
  • Court Order
  • Other Legal Reasons

To schedule an appointment or receive a free consultation, please contact us by phone at 1-416-290-1919 or by e-mail using the contact form on our contact page.

You will receive the results by email within 7-10 working days after we received the DNA samples in our laboratory. In cases where discrete samples are used it may take little longer for the results to be available.

For a legal paternity DNA test, strict chain of custody documentation is required to ensure the court admissibility of the test results for paternity disputes such as child custody and child support. We highly recommend you Contact Us and discuss your DNA test requirement with our forensic DNA expert. This will ensure the right DNA test selection for your legal objectives. An appointment, in-person, must be made to do DNA testing for legal purposes.

What is The Difference Between a Home Paternity Test and a Legal Paternity Test?

Technically, there is no difference between a Home Paternity Test (aka Peace of Mind Test or Curiosity Test) and a Legal Paternity Test. The only difference lies in the way the DNA samples are collected. For a home paternity test, you can simply order a DNA sampling kit online, receive the kit at home and collect samples yourself from the comfort of your home. The DNA kit includes detailed instructions on “How to collect DNA samples” using sterile oral cotton swabs and documentation for labeling and consent of the test participants. Once the samples are collected you just send them to our laboratory for analysis and receive the results in 7-10 working days.

If you need the results of a paternity DNA test to be used in a legal context, Forensics Canada Inc (FCI) offers Legal DNA Testing Service that ensures the admissibility of the DNA test results in court. For Legal Paternity DNA Tests, samples are collected following a strict chain of custody. Test participants must book an appointment with CFI and samples will be collected by a nurse to ensure the positive identification of the test participants. The results of a legal paternity test do not differ from that of a peace of mind (curiosity) paternity test and should be the same.

Frequently Asked Questions – Legal DNA Testing

No, for legal paternity DNA testing a strict chain of custody must be followed to make the test results court admissible. Chain of custody outlines when, where and how a DNA sample was collected and handled  (starting from the moment the DNA sample was collected and ending with the disposition of the sample). A continuous and complete chain of custody ensures the identity and integrity of the DNA sample. For home paternity test, there is no way of tracking the origin and handling of the DNA sample thereof chain of custody is not maintained.

Mother’s participation in the DNA test is optional. Although mother’s participation is recommended, it’s not required. A child inherits 50% of its DNA from the biological father and 50% from the biological mother. By comparing the mother’s DNA profile with that of a child we can determine which half of the DNA profile came from the mother and which half must come from the biological father. Thus making DNA test results more conclusive. In extremely rare cases mother’s absence in the testing can produce inconclusive result.

A paternity DNA DNA test is scientifically considered to be the most accurate testing method available. In cases of “inclusion of paternity” where a man is highly likely to be the biological father with about 99.9% accuracy, or that he is excluded as being the biological father with 100% accuracy.

Our turnaround time for home paternity tests is 7-10 workings days beginning the day we received all samples in our lab. The only exception to this time frame is for Legal DNA testing where it may take 10-14 working days for the results to be emailed to the test participants. We may require additional time to process discrete samples (samples other than swabs).

No, arrangements can be made to collect DNA samples from participants at different times.

No, a legal DNA test collection cannot be completed without proof of identity that has to be valid, original and goverment issued.
