Please read these Terms and Conditions carefully before placing an order.

By ordering or using our services, you agree to be bound by these Terms.

1. DEFINITIONS

1.1 “Company” means Forensics Canada Inc., located at 200 Town Centre Court, Unit 5, Scarborough, ON M1P 4X8, Canada.

1.2 “Client” means any individual, business, or legal entity ordering a Service.

1.3 “Nominated Person” means the individual designated to receive the test results.

1.4 “Sampler” means the person responsible for collecting biological samples.

1.5 “Service” means any DNA testing, fingerprinting, or related service offered by the Company.

1.6 “Order” means a request for Services placed via website, phone, email, or in person.

1.7 “Price” means the fee listed at the time of purchase (in CAD unless stated otherwise).

1.8 “Kit” means the DNA sample collection kit provided to the Client.

2. APPLICATION OF TERMS

2.1 These Terms apply to all Services and override any other terms proposed by the Client.

2.2 An Order is considered accepted only after full payment is received.

2.3 These Terms do not limit any rights you may have under applicable Canadian consumer protection laws.

2.4 If any part of these Terms is found unenforceable, the remaining provisions will remain valid.

3. COMPANY RESPONSIBILITIES

3.1 The Company facilitates testing through accredited third-party laboratories (e.g., ISO/IEC 17025 and/or AABB where applicable).

3.2 The Company aims to deliver results within estimated timeframes. Time begins when samples are received at the laboratory—not when collected.

3.3 The Company is not responsible for delays caused by:

  • Postal or courier services
  • Government agencies
  • Laboratory processing delays beyond reasonable control

3.4 If a Kit arrives damaged, a replacement will be provided (return shipping may apply).

3.5 Additional kits may incur administrative fees.

3.6 If samples are insufficient or contaminated, a re-sampling fee may apply.

3.7 The Company does not guarantee conclusive results. No refunds are issued for inconclusive outcomes.

3.8 While testing is highly accurate, no test is error-free. Liability, if proven, is limited as described in Section 10.

3.9 The Company may refuse Services if:

  • Samples are obtained without proper consent
  • The purpose is unlawful or unethical
  • Service integrity may be compromised

3.10 Results are released only to the Nominated Person and authorized individuals.

3.11 The Company may share results with tested individuals or legal guardians where appropriate.

3.12 Complaints must be submitted in writing. The Company will investigate and respond within a reasonable timeframe.

4. CLIENT RESPONSIBILITIES

4.1 The Client must:

  • Provide accurate information
  • Ensure proper identification (if required)
  • Follow all instructions for sample collection

4.2 The Client is responsible for ensuring:

  • Legal consent for DNA sample collection
  • Compliance with applicable Canadian laws

4.3 The Client agrees to indemnify the Company for any claims arising from unlawful sample collection.

4.4 The Client is responsible for ensuring safe and timely delivery of samples.

4.5 The Company is not liable for lost, delayed, or damaged shipments sent by the Client.

4.6 The Client must ensure that the Nominated Person maintains confidentiality of results.

5. IMPORTANT SERVICE DISCLAIMERS

5.1 Third-Party Laboratories
All DNA testing is performed by independent accredited laboratories. The Company acts as a collection and administrative service provider.

5.2 No Legal or Medical Advice
Services do not constitute legal or medical advice.

5.3 No Guarantee of Acceptance
The Company does not guarantee acceptance of results by:

  • Courts
  • Immigration authorities (e.g., IRCC)
  • Law enforcement agencies (e.g., RCMP)
  • Any third-party organization

5.4 Legal vs Non-Legal Testing
Home DNA tests are not admissible in court. Legal tests require strict chain-of-custody procedures.

6. FEES FOR SERVICES

6.1 All prices are listed in Canadian Dollars (CAD) unless otherwise stated.

6.2 Prices are subject to change without notice.

7. PAYMENT & CANCELLATION

7.1 Full payment is required before Services begin.

7.2 Payment processing fees (if any) are the Client’s responsibility unless stated otherwise.

7.3 Orders expire if samples are not submitted within 3 months. Reactivation fees may apply.

8. REFUND POLICY

8.1 Full refund if cancelled before Kit shipment.

8.2 Partial refund (less admin/postage fees) if cancelled after Kit shipment but before sample submission.

8.3 No refund once samples are received or testing has begun.

9. DATA PROTECTION & PRIVACY

9.1 The Company complies with Canadian privacy laws, including PIPEDA.

9.2 Personal data and biological samples are used only for:

  • Providing Services
  • Legal compliance
  • Administrative purposes

9.3 Data may be shared with:

  • Accredited laboratories
  • Logistics providers
  • Regulatory authorities (if required)

9.4 Biological samples and records are retained only as long as necessary:

  • Legal cases: per accreditation requirements
  • Non-legal cases: limited retention period

9.5 Clients may request access, correction, or deletion of their data where permitted by law.

10. LIMITATION OF LIABILITY

10.1 To the maximum extent permitted by law, the Company is not liable for:

  • Indirect or consequential damages
  • Loss of income, opportunity, or reputation

10.2 Total liability shall not exceed the amount paid for the Service.

10.3 Nothing excludes liability where prohibited by law (e.g., gross negligence).

11. FORCE MAJEURE

The Company is not liable for delays or failures caused by events beyond its control, including:

  • Natural disasters
  • War or strikes
  • System failures
  • Government actions

12. INTELLECTUAL PROPERTY

All reports, documents, and materials remain the property of the Company.

They may not be reproduced without written consent.

13. GOVERNING LAW

These Terms are governed by the laws of the Province of Ontario, Canada.

All disputes shall be resolved in the courts of Toronto, Ontario.
